UAB JOSTRA and law firm GLIMSTEDT Bernotas & Partners invite representatives of municipalities and municipal companies responsible for municipal waste management and Regional Waste Management Centres (RWMCs) to a seminar-discussion where we will discuss the work of the RWMCs and municipalities/municipal companies that are necessary for the successful transition to the new system of waste management charges in Lithuania. It will also explore the legal aspects of the provision of waste collection and management services – public procurement contracts and internal transactions – in the context of the latest legal regulation and case law.

Seminar – discussion issues
As you know, the process of approval of regional prices and their components by the State Energy Regulatory Council (SERC) is coming to an end. It is important to note that this is only the first step in a change in pricing in the municipal waste management sector. In particular, RWRCs will have to calculate and justify the full cost of waste management, taking into account the volume of costs that are not eligible for inclusion in the VERT regulated price. This cost will then have to be integrated into local charges/tariffs.
2023 m. 27 October New 2013 approved 24 July 711 of the Government of the Republic of Lithuania, which approved the Methodology for Determining the Amount of the Fee or Other Charge for the Collection of Municipal Waste from Waste Holders and Waste Management (hereinafter referred to as the Methodology). The recast of this document raises new questions about the solutions for the determination of the binary charge for municipal waste management (MSWM) and the new treatment of the solidarity principle creates new methodological challenges.
In order to successfully implement the approved Methodology in a timely manner, to prevent problems from arising, and to ensure proper and sustainable municipal waste (MSW) management charging, it is necessary to take immediate action and to start preparations for both the calculation of full waste management charges, the innovative application of the solidarity principle, and the updating of the parameters and amounts of the DVR.
The authorities responsible for the renewal of the tax should start preparing for this important change as early as possible. During the seminar-discussion, we will present our ideas on this integrated solution.
Recently, the legal framework for domestic transactions has changed several times. In addition, the Constitutional Court of the Republic of Lithuania and the Supreme Court of the Republic of Lithuania have spoken on this issue. The topic has also been developed in lower courts and in institutional practice. How should waste collection and management be organised from a legal point of view: through public procurement, internal transactions or other means? We will discuss these and other aspects in the context of recent legislation and case law.
Discussions, sharing of experience and finding solutions to problems will play an important role in the event, so please share your questions (problems) related to the topics of the seminar when registering. We will try to find solutions during the seminar.
